Can foreigners own property in Indonesia?

Foreigners cannot hold Hak Milik (freehold). However, they can hold Hak Pakai (right of use) for residential property, or lease property long-term. PT PMA structures are also used for commercial property.

What is an AJB and why is it important?

An AJB (Akta Jual Beli) is the notarial deed of sale executed by a PPAT (Land Deed Official). It is the primary legal instrument for transferring land ownership and must be registered with BPN.

What is the difference between SHM, HGB, and HGU?

SHM (Sertifikat Hak Milik) is freehold, available only to Indonesian citizens. HGB (Hak Guna Bangunan) is a 30-year building right available to companies. HGU (Hak Guna Usaha) is for agricultural use.

What due diligence should I do before buying property?

At minimum: verify the certificate at BPN, check for encumbrances and mortgages, review RTRW zoning, confirm the seller's identity, and have a PPAT review all transaction documents.

What happens if a developer defaults on a pre-sale (PPJB) agreement?
