How long does a divorce take in Indonesia?

An uncontested (consensual) divorce typically takes 3–6 months. Contested divorces can take 1–3 years depending on the complexity of disputes around assets and custody.

Is a prenuptial agreement legally enforceable in Indonesia?

Yes, if properly drafted and notarized before the marriage is registered. Since 2016, the Constitutional Court has also permitted postnuptial agreements under certain conditions.

Who gets custody of the children in an Indonesian divorce?

Courts generally award custody based on the best interests of the child. For children under 12, mothers are presumed to have priority, but fathers can contest this with strong evidence.

Can I get a divorce if my spouse refuses?

Yes. In Indonesia you can file for a contested divorce through the Religious Court (for Muslims) or the District Court (for non-Muslims) — your spouse's consent is not required.

How is property divided in an Indonesian divorce?

Community property (harta bersama) acquired during marriage is divided equally. Premarital assets and gifts or inheritance remain separate property — unless a prenuptial agreement states otherwise.
